UNVEILING CANADA’S JUDICIAL SYSTEM TO DEMOCRATIC REPUBLIC OF CONGO HIGH COURT OFFICIALS
The Centre for Sustainable Operations and Innovation (CSOI) will host two delegations of officials from the DRC High court officials during visits to Canada in September and October 2025, respectively. This initiative has two primary objectives:
a) to provide DRC High Court officials with insights into Canada’s judicial system, enhancing their understanding and contributing to the development of the DRC’s legal framework;
b) to create opportunities for Canadian organizations to explore potential business partnerships within the DRC judicial sector.
Aligned with its mission to foster the exchange of best practices, CSOI aims to promote a mutually beneficial dialogue that supports the strengthening of the rule of law in the DRC while encouraging greater Canadian engagement in the region
Overview
The Democratic Republic of Congo (DRC) promulgated its constitution on February 18, 2006, introducing a complete reorganization of its judicial system. The system structured into two orders of jurisdiction and a Constitutional Court. The judicial order, encompassing civil and military courts, is overseen by the Court of Cassation, the highest judicial authority. The administrative order falls under the jurisdiction of the Council of State, its supreme authority for administrative matters. Since then, the country has undertaken several reforms aimed at modernizing and harmonizing the laws and regulations governing its judicial system.
Despite this progress, significant challenges remain. Efforts to strengthen the rule of law continue through a range of initiatives focused on judicial reform, enhancing the system’s independence and efficiency, and ensuring equal access to justice for all citizens. This project is part of those efforts. Its primary objective is to expose senior judges and prosecutors from the highest courts of the DRC to the practices, procedures, and legal frameworks of the Canadian judicial system — and to demonstrate how this system can serve as a source of inspiration for the DRC and contribute to its ongoing reforms
Canada is selected because of its unique legal system, which blends civil law and common law traditions. Its judicial structure, comprising both federal and provincial courts, mirrors the DRC’s own distribution of powers between the central government and the provinces. In addition, Canada’s legal system fosters innovation, in contrast to the DRC’s system, which remains largely rooted in the Belgian and French legal traditions. Canada is also chosen for its strong bilateral and multilateral cooperation with the DRC. According to 2022 to Global Affairs Canada (2022), the DRC was among the five top recipients of Canadian development assistance, ranking second in Africa after Ethiopia.
2. SPECIFIC OBJECTIVESOF THE INITIATIVE1- To deepen understanding of Canadian judicial practices, procedures and legal frameworks.
- To foster professional exchanges and collaboration between DRC and Canadian judicial officials.
- To identify best practices and lessons learned that can be adapted to improve the DRC’s judicial system.
- To strengthen the capacity of DRC judicial officials in areas such as judicial independence, ethics and case management.
3. PARTICIPANT ORGANISATIONS
During their visit to Canada, the delegation from the DRC High Court will hold working sessions with officials from various Canadian organizations, including those listed below.
